How to File a Human Rights Complaint
A human rights complaint can be filed when a person believes that their basic rights, dignity, liberty, equality, or other protected rights have been violated, particularly through the actions or negligence of a public authority or public servant. In India, one of the principal institutions for such complaints is the National Human Rights Commission (NHRC), established under the Protection of Human Rights Act, 1993. State Human Rights Commissions may also have jurisdiction over appropriate matters within their respective states.
Governing Body
The National Human Rights Commission (NHRC) is the national statutory body responsible for promoting and protecting human rights in India. Its functions include examining complaints, conducting inquiries, seeking reports from authorities, recommending appropriate action or relief, and promoting human-rights awareness.
Depending on the nature of the complaint, other institutions may also be appropriate, including a State Human Rights Commission, court, police authority, or specialized statutory commission.

How to File a Human Rights Complaint
Step 1: Collect the Information
Prepare a clear record containing:
Name and contact details of the complainant
Name and details of the victim
Date and place of the incident
Description of what happened
Details of the public servant, department, or authority involved
Copies of relevant documents and evidence
Details of any complaint already submitted
Relief or action requested
The NHRC’s online complaint form specifically asks for complainant, victim, incident, authority, allegation, and relief details.
Step 2: Write the Complaint
The complaint should be clear, factual, and self-contained. Explain what happened in chronological order and attach available supporting documents such as photographs, medical records, official correspondence, or other relevant evidence.

The NHRC states that no fee is charged for filing a complaint. Complaints may be submitted in Hindi, English, or languages included in the Eighth Schedule of the Constitution.

Step 4: Keep the Complaint Number
After registration, the complainant should retain the diary/case/reference number provided by the Commission. This can be used to follow the progress of the complaint through the complaint-status system.
Step 5: Follow Up
The NHRC may request information or a report from the concerned government or authority. After considering the material available, it may take appropriate steps within its statutory powers.
Important Limitations
Not every grievance falls within the NHRC’s jurisdiction. The Commission ordinarily does not entertain complaints concerning matters such as incidents occurring more than one year before filing, matters pending before a court, vague or anonymous complaints, frivolous complaints, and service matters.
Therefore, the appropriate forum should be selected according to the facts and legal nature of the case.
